The same process as we discussed before - we would probably get on in Court for the first hearing within a week of being instructed at which an interim order would likely be made. The Court will also set a date for the return hearing – and we would be required to give notice of that return hearing to Smith Andrews and Melbourne such that they may attend/be represented. At the second hearing, the Court will either continue, vary or discharge the order made at the first.

As discussed, you would be required to provide an undertaking (possibly fortified) in damages in relation to any losses suffered by the defendants if the Court ultimately decides in their favour. It is difficult to predict what this might be but it is likely to be significant.

To issue the claim, the court fee alone will be £10,000. We would need that on account together with a further £15,000 to cover our and Counsel’s fees for drafting the documentation required for the application.

I should also point out, which is of paramount importance to the Court, that a party seeking injunctive relief has a duty of full and frank disclosure to the Court, especially when making a without notice application. It will be necessary as such if you do go for an injunction that you let us have all relevant material including all correspondence (contemporaneous and recent) you have had with all three.

Dear Clare,

Yes, we will have to proceed to legal action, as otherwise Smith will think he can continue to work on the Commodore project and that he owns the IP, and there is technical stuff we need to get out of him.

Please advise what you will need from us, what the various stages/options are, and
approximate cost estimates going forward.

No. I will chase Pictons and Melbourne but in the absence of any meaningful and speedy replies, your only real option is to go for an injunction/issue proceedings. Do you want to that now that you are in control of RCL?
